EWS quota

In News 
  • In a landmark ruling Monday, the Supreme Court upheld by a 3-2 majority the Constitution (One Hundred and Third Amendment) Act, 2019 introducing 10 percent reservation for the economically weaker sections (EWS) among the unreserved categories in admissions and government jobs.
About the Judgment
  • The state can make special provisions and the exclusion of SEBCs, STs, SCs, and OBCs does not violate the equality code. Reservation should have a deadline to usher in an egalitarian society. Efforts should be made to eliminate the causes of backwardness.
  • Reservation on the basis of economic criterion is per se valid, but excluding others who are backward (SC/ST/OBC/SEBC) is a violation of the basic structure. All the poorest, regardless of caste or class, are discriminatory. Strikes at the essentials of non-discriminatory rule.
  • The government maintained that the 10% quota was not an addition to the 50% ceiling on the reservation. It said the EWS quota was an “independent compartment”. The government has said it will increase seats by 25% in its institutions to accommodate the EWS quota.
EWS Quota 
  • 103 Constitutional Amendment Act: It introduced an economic reservation (10% quota) in jobs and admissions in education institutes for Economically Weaker Sections (EWS) by amending Articles 15 and 16.
  • It inserted Article 15 (6) and Article 16 (6).
  • It was enacted to promote the welfare of the poor not covered by the 50% reservation policy for SCs, STs and Socially and Educationally Backward Classes (SEBC).
  • It enables both Centre and the states to provide reservation to the EWS of society.
